These Terms of Service ("Terms") govern your firm's use of FreshFilings, the service offered at tryfreshfilings.com (the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of your firm. If you do not agree, do not use the Service.
FreshFilings compiles publicly available consumer bankruptcy filing records from the U.S. Bankruptcy Court for the Central District of California, organizes them by territory zone, and provides an online tracker subscribers use to manage follow-up: search, filters, per-filing statuses, private notes, and CSV export. For pro se filings (those without an attorney of record) in a subscribed zone, the Service also re-checks the public docket on a scheduled basis and flags cases the court has dismissed, showing the dismissal date in the tracker. FreshFilings is a data and workflow service. It is not a law firm, does not provide legal advice, and does not create any attorney–client relationship with any person, including the debtors whose filings appear in the Service.
The Service is offered to law firms and licensed attorneys for use in their own practices. The person creating an account represents that they are authorized to bind the firm. You are responsible for the accuracy of your account information, for safeguarding your password, and for all activity under your account. One account serves one firm; accounts may not be shared with other firms or unaffiliated third parties.
The Service area is divided into territory zones. Each zone is offered on one of two bases, and a zone is either shared or exclusive — never both at the same time:
Shared. Up to five (5) firms may hold shared subscriptions in the same zone. When all five seats are taken, the zone is closed to new shared subscriptions.
Exclusive. One firm holds the zone alone. An exclusive subscription is available only while a zone is completely empty — no shared or exclusive subscription in effect — and the first exclusive subscription locks the zone for its term. While a zone is held exclusively, no other firm may subscribe to it on either basis.
Conversion. A firm that is the sole firm holding a shared seat in a zone may convert that seat to an exclusive subscription for the same zone. Conversion is not available while any other firm holds a seat in the zone.
Cancellation frees the seat. When a subscription ends — by cancellation, expiration without renewal, or termination — its seat is released immediately and the zone's availability is recalculated at once.
We may decline, hold, or discontinue a subscription or claim that would breach a zone's occupancy rules, and we may correct occupancy errors, including by cancelling a subscription created in error with a refund of any amount charged for it.
A coupon code (such as FREEMONTH) may provide an initial free period, currently thirty (30) days from activation. Trial subscriptions use filings that have already been compiled; the live daily feed for a zone begins when paid territories launch. No payment method is required to start a trial, and nothing is charged during a trial. When a trial ends, no new filings are added to your tracker; your saved leads, statuses, and notes remain in your account, and filings for your zones resume if you subscribe. We may limit trial eligibility (for example, one trial per firm) and may end a trial early for misuse of the Service.
Paid subscriptions are billed monthly in advance at the rates in effect when you subscribe — currently Shared $497 per zone per month and Exclusive $2,997 per zone per month, with a 20% discount on the second and each subsequent zone. Card payments are processed by Stripe; we do not receive or store your full card number. Fees are exclusive of taxes, which are your responsibility where applicable. Fees are non-refundable except where required by law. We may change prices for future billing periods; changes apply from your next renewal after notice.
You may cancel any zone subscription at any time from your Account & Billing page. Cancellation takes effect immediately, frees the territory seat (see Section 3), and is not prorated. If a subscription is attached to a Stripe subscription, cancellation in the Service ends your access and seat; you are responsible for confirming the corresponding billing cancellation, and we will process Stripe-side cancellations communicated through Stripe's systems.
Filing records in the Service are compiled from public court records and public sources. Records are provided "as is," without any warranty of accuracy, completeness, or currency; source records occasionally contain errors, and records may change after compilation (for example, a filing may be amended, dismissed, or converted). Verify every record against the court's own records before acting on it. FreshFilings does not append or supply debtor telephone numbers or email addresses.
You are solely responsible for how your firm uses filing records and for your firm's compliance with all applicable law and professional rules, including the California Rules of Professional Conduct (including Rule 5.3 on responsibilities regarding nonlawyer assistance and Rules 7.1 through 7.3 on communications concerning a lawyer's services, advertising, and solicitation), the United States Bankruptcy Code (including 11 U.S.C. § 362 and § 528, where applicable), and federal and state laws governing mail, telephone, and electronic communications. FreshFilings does not review, approve, draft, or supervise your communications with any debtor or other person, and nothing in the Service is legal advice about your obligations.
You agree not to: (a) share your account credentials or your zone access with any other firm or person outside your firm; (b) resell, redistribute, or publish the compiled data, in bulk or as a standalone list product; (c) use the Service or its data for any unlawful purpose or in any communication that is false or misleading; (d) scrape, crawl, or otherwise extract data from the Service by automated means other than the exports the Service itself provides; (e) interfere with the Service's operation or security, or attempt to access another firm's account, subscriptions, or tracker data; or (f) misrepresent your affiliation with FreshFilings.
The Service, including its compilations, organization, zone structure, software, and site content, belongs to FreshFilings or its licensors. Your subscription gives your firm a limited, non-transferable license to use the filings delivered for your zones within your firm's own client-development and case-intake work. The underlying court records are public records and remain public; no term here restricts your use of records you obtain independently from the court.
We work to keep the Service available and the data flowing, but the Service is provided without any commitment of uninterrupted or error-free operation, and filing data depends on public sources outside our control. We may modify, add, or discontinue features, zones, or plans; material changes will be posted on this page or communicated through the Service.
You may terminate at any time by cancelling (Section 5). We may suspend or terminate an account for material breach of these Terms, non-payment, misuse of the Service, or conduct that exposes us or other subscribers to legal risk, with notice where practicable. On termination, access ends and territory seats are freed; tracker data is handled as described in the Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY FILING RECORD IS ACCURATE OR COMPLETE, OR THAT USING THE SERVICE WILL PRODUCE ANY PARTICULAR RESULT FOR YOUR FIRM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FRESHFILINGS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CLIENTS, OR LOST REVENUE, ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO FRESHFILINGS IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold FreshFilings harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your firm's use of the Service or filing data, your communications with any debtor or other person, or your breach of these Terms or of applicable law or professional rules.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Los Angeles County, California, and the parties consent to personal jurisdiction there.
These Terms are the entire agreement between you and FreshFilings regarding the Service and supersede prior understandings about it. You may not assign these Terms or your account without our written consent; we may assign in connection with a sale or reorganization of the Service. If any provision is held unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver of it.
We may update these Terms from time to time. The current version is posted on this page with its effective date; continued use of the Service after an update constitutes acceptance of the updated Terms.
